Nutzungsbedingungen

Diese Bedingungen gelten für die App QuizLane und die zugehörigen Online-Dienste der omo-net GmbH (Angaben im Impressum).

1. Leistungen

Mit QuizLane erstellst, verwaltest, teilst und lernst du Quizze. Lernen, Prüfungsmodus und das Öffnen erhaltener Quizze funktionieren ohne Konto und offline. Für eigene Quizze, ihre Weitergabe, Community, Synchronisierung, gemeinsames Lernen und die KI brauchst du ein Konto und eine Internetverbindung. Wir bemühen uns um eine hohe Verfügbarkeit der Online-Dienste, können sie aber nicht garantieren. Ein Anspruch auf dauerhafte Verfügbarkeit oder auf eine Weiterentwicklung besteht nicht; für die Einstellung des Dienstes gilt Abschnitt 8.

2. Konto

Die Anmeldung erfolgt mit deiner E-Mail-Adresse und einem Code. Halte den Zugang zu deinem E-Mail-Postfach geschützt. Du kannst dein Konto jederzeit in der App löschen.

Schülerkonten: Eine Kursleitung kann Schülern den Beitritt ohne E-Mail-Adresse ermöglichen – mit dem Kurs-Code und einem selbst gewählten Spitznamen oder mit einer persönlichen QR-Karte. Angemeldet wird dann mit dem Schülercode bzw. der Karte; wer sie besitzt, kann das Schülerkonto nutzen. Bewahre sie daher wie ein Passwort auf. Ein Schülerkonto gehört zum Kurs: Entfernt die Kursleitung es aus dem Kurs, wird es gelöscht. Es kann jederzeit mit einem eigenen Konto übernommen werden.

3. Deine Inhalte

Du bleibst Urheber deiner Quizze. Stellst du ein Quiz über eine private Freigabe (Code, QR-Code, Link) bereit, räumst du uns das einfache, unentgeltliche Recht ein, es zu speichern, zu vervielfältigen und den Empfängern zugänglich zu machen – bis du die Freigabe abschaltest. Bereits heruntergeladene Kopien bleiben bei den Empfängern.
Community: Veröffentlichst du ein Quiz in der Community oder bringst du Inhalte als Mitarbeiter in ein Community-Quiz ein, räumst du der omo-net GmbH daran ein einfaches, zeitlich, räumlich und inhaltlich unbeschränktes, unwiderrufliches, übertragbares und unterlizenzierbares Nutzungsrecht ein. Es umfasst insbesondere das Speichern, Vervielfältigen, Verbreiten, öffentliche Zugänglichmachen, Bearbeiten, Übersetzen (auch per KI) und Zusammenstellen mit anderen Inhalten, die Nutzung in QuizLane und in anderen Angeboten der omo-net GmbH (z. B. Brainpong) sowie zur Werbung für diese Angebote – auch kommerziell. Die Einräumung ist unentgeltlich; Ersteller-Credits (Abschnitt 6) sind eine freiwillige Beteiligung. Ziehst du ein Quiz zurück oder löschst du dein Konto, nehmen wir es aus dem Community-Katalog, und dein Name wird entfernt; das eingeräumte Recht und bereits bezogene Kopien bleiben bestehen. Du selbst darfst deine Inhalte weiterhin uneingeschränkt nutzen.
Vor einer Veröffentlichung bestätigst du, dass du die Inhalte selbst erstellt hast oder eine Lizenz besitzt, die die Veröffentlichung und Weitergabe in der App erlaubt, und dass erforderliche Namensnennungen hinterlegt sind.
Erlaubst du die Mitarbeit, können andere Nutzer Änderungen vorschlagen; übernommen wird nur, was du oder von dir benannte Prüfer freigeben. Erlaubst du die Wiederverwendung eines Bausteins, dürfen andere ihn in eigene Quizze einbinden.

4. Verbotene Inhalte und Moderation

Nicht erlaubt sind insbesondere rechtswidrige, diskriminierende, gewaltverherrlichende, pornografische oder jugendgefährdende Inhalte sowie Inhalte, die Rechte Dritter verletzen. Gemeldete Quizze werden vorläufig verborgen und von uns geprüft; wir können sie wieder freigeben, Änderungen verlangen oder dauerhaft entfernen. Missbräuchliche Meldungen sind untersagt. Bei schweren oder wiederholten Verstößen können wir ein Konto sperren.

5. KI-Erstellung und KI-Übersetzung

KI-Entwürfe und -Übersetzungen können Erkennungsfehler und sachlich falsche Antworten enthalten. Prüfe sie vor der Übernahme. Lade nur Inhalte hoch, die du dafür verwenden darfst, und keine personenbezogenen Daten Dritter.

Mit KI erstellte Fragen sind als „KI-erstellt“ gekennzeichnet, per KI übersetzte Sprachen als „KI-übersetzt“. Die Kennzeichnung bleibt auch nach einer Bearbeitung und ist in der Community sichtbar; sie darf nicht umgangen werden. Fragen, die du selbst ergänzt, tragen keine KI-Kennzeichnung, sondern deinen Namen als Autor.

6. Abonnement und Credits

Kostenlos ist das Mitmachen: die mitgelieferten Beispielquizze, alles, wozu du eingeladen wirst (Räume, Freigaben, Kurse, Aufgaben, Brainpong-Runden), das Lernen mit deinen Quizzen und das Ansehen der Community.
Ohne Abonnement gegen Credits: ein neues eigenes Quiz einmalig 1 Credit (danach dauerhaft bearbeitbar, exportierbar und teilbar; mit KI erstellte Quizze kosten nur die KI-Credits), ein Community-Quiz 2 Credits (nur zur eigenen Nutzung, ohne Weitergabe), KI-Erstellung und KI-Übersetzung nach Umfang.
Das Abonnement (Pro) schaltet für seine Laufzeit frei: eigene Quizze erstellen und weitergeben, Community-Quizze laden, veröffentlichen und mitbearbeiten, Räume eröffnen, Kurse und Aufgaben, Synchronisierung, Pro-Stimme und Videos – und enthält monatliche KI-Credits.
Willkommenszeit: Neue Konten können 60 Tage ab der Anmeldung alle Funktionen des Abonnements kostenlos nutzen – ausgenommen die KI (über Credits) und die Pro-Stimme. Die Willkommenszeit endet automatisch; ein Abonnement entsteht dadurch nicht.
Abonnement und Credit-Pakete kaufst du über den App Store bzw. Google Play, das Jahresabonnement auch im Web; es gelten zusätzlich die Bedingungen des jeweiligen Anbieters. Preis, Laufzeit und automatische Verlängerung siehst du vor dem Kauf. Kündigen kannst du jederzeit in den Abo-Einstellungen deines Stores zum Ende der laufenden Periode. Erstattungen richten sich nach den Regeln des Stores.
Das Abonnement enthält 50 KI-Credits je angefangenem Abo-Monat (in der Testphase einmalig 20). Nicht genutzte Abo-Credits werden bis höchstens 100 angesammelt und verfallen mit dem Ende des Abonnements. Gekaufte Credits verfallen nicht. Verbraucht werden zuerst Abo-Credits, dann gekaufte, zuletzt verdiente.
Ein Credit entspricht bei der KI-Erstellung einem Foto bzw. einer Seite oder bis zu 5.000 Zeichen Text; eine erneute Erzeugung aus derselben Vorlage ist einmal kostenlos. Eine KI-Übersetzung kostet 1 Credit je angefangene 50 Fragen. Credits werden erst abgebucht, wenn ein verwertbares Ergebnis vorliegt.
Verdiente Credits: Startet ein neuer Nutzer mit bezahltem Abonnement (ein anderes Konto, nicht Ersteller, Mitarbeiter oder Prüfer) dein Community-Quiz zum ersten Mal, erhältst du 5 Credits. Haben andere mitgearbeitet (mindestens eine Frage in der aktuellen Version), erhält jeder Mitarbeiter 1 Credit und der Ersteller den Rest, mindestens 1. Je Konto werden höchstens 100 Credits in 30 Tagen gutgeschrieben. 20 verdiente Credits lassen sich gegen 30 Tage Pro tauschen (ohne die monatlichen KI-Credits, nicht neben einem laufenden Store-Abonnement). Bei Missbrauch, etwa mit Zweitkonten, können wir Gutschriften zurücknehmen.
Credits haben keinen Geldwert, sind nicht übertragbar und werden nicht ausgezahlt. Bei Löschung des Kontos verfallen sie.
Nach dem Ende des Abonnements oder der Willkommenszeit bleiben deine Inhalte und Lernstände erhalten. Eigene Quizze, die du mit Abonnement, in der Willkommenszeit oder mit Credits erstellt hast, bleiben dauerhaft bearbeitbar, exportierbar und teilbar; erst neue eigene Quizze kosten dann wieder Credits.
Kurse anlegen und Aufgaben versenden setzt ein Abonnement voraus; Beitreten und Bearbeiten ist kostenlos. Kursleitungen und Lehrkräfte sind dafür verantwortlich, nur Daten einzutragen, die sie verarbeiten dürfen, und bei Minderjährigen die nötige Einwilligung einzuholen.

7. Haftung

Wir haften unbeschränkt bei Vorsatz und grober Fahrlässigkeit, bei Verletzung von Leben, Körper oder Gesundheit sowie nach dem Produkthaftungsgesetz. Bei leichter Fahrlässigkeit haften wir nur bei Verletzung wesentlicher Vertragspflichten und begrenzt auf den vorhersehbaren, typischen Schaden. Für Inhalte anderer Nutzer und für die Richtigkeit von Quizinhalten übernehmen wir keine Gewähr; prüfe Lerninhalte für Prüfungen anhand verlässlicher Quellen.

8. Einstellung des Dienstes

Wir dürfen QuizLane insgesamt oder einzelne Online-Dienste (z. B. Community, Räume, KI, Synchronisierung) dauerhaft einstellen. Wir kündigen das mindestens drei Monate vorher in der App und per E-Mail an die Adresse deines Kontos an.
Bis zur Einstellung kannst du deine Quizze exportieren (Datei oder Tabelle). Quizze, die auf deinem Gerät gespeichert sind, kannst du danach weiter offline lernen, soweit die App auf deinem Gerät noch läuft; einen Anspruch auf weitere Updates gibt es nicht.
Ein laufendes Abonnement endet spätestens mit der Einstellung; eine automatische Verlängerung über diesen Zeitpunkt hinaus findet nicht statt. Hast du über den Einstellungszeitpunkt hinaus im Voraus bezahlt, erstatten wir den Anteil für die nicht mehr nutzbare Zeit. Gekaufte, nicht verbrauchte Credits erstatten wir auf Anfrage anteilig zum gezahlten Preis. Verdiente Credits, Gutschriften und die Willkommenszeit begründen keinen Anspruch auf Erstattung.
Müssen wir einen Dienst aus wichtigem Grund kurzfristig einstellen – etwa wegen einer behördlichen Anordnung, einer Rechtsänderung oder einer erheblichen Sicherheitslücke –, informieren wir dich so früh wie möglich; die Regeln zu Export und Erstattung gelten entsprechend.

9. Änderungen

Wir können diese Bedingungen mit Wirkung für die Zukunft ändern, wenn dafür ein sachlicher Grund besteht (z. B. neue Funktionen oder rechtliche Vorgaben). Über wesentliche Änderungen informieren wir dich rechtzeitig in der App.

10. Schlussbestimmungen

Es gilt deutsches Recht unter Ausschluss des UN-Kaufrechts; zwingende Verbraucherschutzvorschriften deines Wohnsitzlandes bleiben unberührt. Fragen? Nutze unser Kontaktformular.

Terms of use

These terms apply to the QuizLane app and the related online services of omo-net GmbH (details in the legal notice).

1. Services

With QuizLane you create, manage, share and learn quizzes. Learning, exam mode and opening quizzes you receive work without an account and offline. Your own quizzes, passing them on, the community, sync, learning together and AI require an account and an internet connection. We strive for high availability of the online services but cannot guarantee it. There is no claim to permanent availability or to further development; section 8 applies to discontinuing the service.

2. Account

You sign in with your e-mail address and a code. Keep access to your mailbox secure. You can delete your account in the app at any time.

Student accounts: a course leader can let students join without an e-mail address – with the course code and a nickname of their choice or with a personal QR card. Students then sign in with the student code or the card; whoever holds it can use the student account, so keep it like a password. A student account belongs to the course: if the course leader removes it from the course, it is deleted. It can be taken over with an own account at any time.

3. Your content

You remain the author of your quizzes. If you provide a quiz via a private share (code, QR code, link), you grant us the simple, royalty-free right to store and copy it and to make it available to the recipients – until you switch the share off. Copies already downloaded remain with the recipients.
Community: If you publish a quiz in the community or contribute content to a community quiz as a co-author, you grant omo-net GmbH a non-exclusive, irrevocable, transferable and sublicensable right of use, unlimited in time, territory and content. It includes in particular storing, copying, distributing, making publicly available, editing, translating (also by AI) and combining with other content, use in QuizLane and in other services of omo-net GmbH (e.g. Brainpong) and in advertising for these services – also commercially. The grant is royalty-free; creator credits (section 6) are a voluntary share. If you withdraw a quiz or delete your account, we remove it from the community catalogue and remove your name; the granted right and copies already obtained remain. You yourself remain free to use your content without restriction.
Before publishing you confirm that you created the content yourself or hold a licence that allows publishing and sharing it in the app, and that required attributions are included.
If you allow collaboration, other users can suggest changes; only what you or reviewers you named approve is applied. If you allow reuse of a module, others may include it in their own quizzes.

4. Prohibited content and moderation

In particular, unlawful, discriminatory, violence-glorifying, pornographic or content harmful to minors as well as content infringing third-party rights is not allowed. Reported quizzes are temporarily hidden and reviewed by us; we may restore them, request changes or remove them permanently. Abusive reports are prohibited. In case of serious or repeated violations we may block an account.

5. AI creation and AI translation

AI drafts and translations may contain recognition errors and factually wrong answers. Review them before you use them. Only upload content you are allowed to use for this, and no personal data of others.

Questions created with AI are labelled “AI-generated”, languages translated by AI “AI-translated”. The label stays after editing and is visible in the community; it must not be circumvented. Questions you add yourself carry no AI label but your name as author.

6. Subscription and credits

Taking part is free: the included sample quizzes, everything you are invited to (rooms, shares, courses, assignments, Brainpong rounds), learning with your quizzes and browsing the community.
Without a subscription, with credits: a new quiz of your own costs 1 credit once (then editable, exportable and shareable for good; quizzes created with AI only cost the AI credits), a community quiz 2 credits (for your own use only, no passing on), AI creation and AI translation by volume.
The subscription (Pro) unlocks for its term: creating and passing on your own quizzes, getting, publishing and co-editing community quizzes, opening rooms, courses and assignments, sync, the Pro voice and videos – and includes monthly AI credits.
Welcome period: new accounts can use all subscription features free of charge for 60 days after signing up – except AI (with credits) and the Pro voice. The welcome period ends automatically; it does not create a subscription.
You buy the subscription and credit packs via the App Store or Google Play, the yearly subscription also on the web; the terms of the respective provider apply in addition. You see price, term and automatic renewal before buying. You can cancel at any time in your store’s subscription settings, effective at the end of the current period. Refunds follow the store’s rules.
The subscription includes 50 AI credits per started subscription month (20 once during the trial). Unused subscription credits accumulate up to 100 and expire when the subscription ends. Purchased credits do not expire. Subscription credits are used first, then purchased ones, earned ones last.
For AI creation one credit equals one photo or page or up to 5,000 characters of text; regenerating from the same source is free once. An AI translation costs 1 credit per started 50 questions. Credits are only deducted once a usable result exists.
Earned credits: when a new user with a paid subscription (another account, not the creator, a co-author or reviewer) starts your community quiz for the first time, you receive 5 credits. If others contributed (at least one question in the current version), each co-author receives 1 credit and the creator the rest, at least 1. At most 100 credits are credited per account within 30 days. 20 earned credits can be exchanged for 30 days of Pro (without the monthly AI credits, not alongside an active store subscription). In case of abuse, e.g. with secondary accounts, we may reverse credits.
Credits have no cash value, are not transferable and are not paid out. They expire when you delete your account.
After the subscription or the welcome period ends, your content and learning progress remain. Quizzes of your own that you created with the subscription, during the welcome period or with credits stay editable, exportable and shareable for good; only new quizzes of your own cost credits again.
Creating courses and sending assignments requires a subscription; joining and working on them is free. Course leaders and teachers are responsible for entering only data they may process and for obtaining the necessary consent for minors.

7. Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health and under the German Product Liability Act. For slight negligence we are only liable for breach of essential contractual obligations, limited to the foreseeable, typical damage. We give no warranty for content of other users or for the correctness of quiz content; check learning content for exams against reliable sources.

8. Discontinuation of the service

We may permanently discontinue QuizLane as a whole or individual online services (e.g. community, rooms, AI, sync). We announce this at least three months in advance in the app and by e-mail to your account address.
Until the discontinuation you can export your quizzes (file or spreadsheet). Quizzes stored on your device can still be learned offline afterwards as long as the app keeps running on your device; there is no claim to further updates.
An active subscription ends at the latest when the service is discontinued; it does not renew automatically beyond that date. If you prepaid beyond the discontinuation date, we refund the share for the time that can no longer be used. Purchased, unused credits are refunded on request pro rata to the price paid. Earned credits, gifts and the welcome period do not give rise to a refund.
If we have to discontinue a service at short notice for an important reason – e.g. an order by authorities, a change in the law or a serious security vulnerability – we inform you as early as possible; the rules on export and refunds apply accordingly.

9. Changes

We may change these terms with effect for the future if there is a valid reason (e.g. new features or legal requirements). We will inform you about material changes in good time in the app.

10. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer protection rules of your country of residence remain unaffected. Questions? Use our contact form.
